Lawyers Suspended Over Misconduct
A disciplinary tribunal has decided to suspend three advocates from the Roll of Advocates due to disciplinary actions taken against them for professional misconduct.
As stated in a Gazette notice from October 9, these advocates were found guilty, leading to their suspension for different lengths of time.
“PURSUANT to Section 69 (2) of the Advocates Act, Cap. 16, Laws of Kenya, it is notified for the information of the general public that final orders were made and the following Advocates were suspended from the Roll of Advocates by the Disciplinary Tribunal pursuant to orders issued in their respective Disciplinary Tribunal Cause (DTC),” notice reads
The names were published the Chief Registrar of the Judiciary, Winfridah Mokaya.
Mokaya mentioned that this decision came as a result of directives from the relevant Disciplinary Tribunals overseeing the advocates.
As a consequence of this disciplinary measure, the advocates listed are barred from performing any advocacy duties in Kenya for the length of their suspension.
Those who are suspended are not allowed to represent clients or appear in court anywhere in the country unless they have explicit permission from the Registrar.
This recent suspension comes on the heels of a significant event a few years back when nine lawyers were removed from the Roll of Advocates due to malpractice.
In 2023, Anne Amadi, the former Chief Registrar of the Judiciary, approved the recommendations from the Advocates Disciplinary Tribunal, leading to the removal of those nine advocates from the Roll.
The specific charges against these lawyers were kept under wraps.
Back in 2018, another 20 lawyers faced a similar fate and were also struck from the list.
The law takes a strong stance against any form of professional malpractice, which includes any disgraceful or dishonorable behavior that doesn’t align with the dignity of being an advocate.
Anyone can file a complaint about such conduct to a tribunal.
