The High Court has overturned the 100-year prison sentence handed to Stephen Nzuki Mutisya, a former director of a children’s home who had been convicted of sexually abusing four minors under his care.

Nzuki was initially found guilty by Nairobi Principal Magistrate Zainab Abdul, who delivered a scathing verdict after hearing disturbing testimony from the victims. The court had ruled that Nzuki, who was entrusted with the welfare of vulnerable children, had violated that trust in the most shocking manner.

During the original trial, it was revealed that Nzuki would often quote Bible verses while committing the assaults, manipulating the children into believing that his actions were somehow acceptable or divinely justified. The prosecution described his conduct as predatory and deceitful, calling for a sentence that reflected both the gravity of his crimes and the need to protect other children.

However, the High Court has now set aside both his conviction and sentence, ruling that the previous judgment was unsafe. The court noted that there were significant procedural flaws and gaps in the evidence presented during the trial. As a result, Nzuki’s conviction has been quashed, and his 100-year sentence nullified.

The decision means that Nzuki will be released from prison unless he faces other pending charges. The ruling has sparked widespread public debate, with children’s rights advocates and members of the public expressing shock and disappointment. Many have argued that the ruling could discourage victims of sexual abuse from coming forward, fearing that justice may not be served.

Human rights groups are now calling for the Office of the Director of Public Prosecutions (ODPP) to review the case and consider an appeal. They have also urged for better protection of child witnesses in sexual offence cases to ensure that justice is not derailed by technicalities.

For now, the release of Stephen Nzuki Mutisya marks a controversial turn in a case that once symbolized accountability for those entrusted with the care of society’s most vulnerable children.
