Samidoh Faces Rape Accusations
The High Court has put in place temporary orders that prevent Kikuyu musician Samuel Muchoki, better known as Samidoh, from contacting or interfering with a woman who has filed a lawsuit against him regarding rape allegations.
“…pending the hearing and determination of the instant application, an interim non-contact and non-interference order is hereby issued restraining the Interested Party, whether by himself, his servants, agents or assigns, from contacting, intimidating, harassing or otherwise interfering…” reads the order.
Justice Lawrence Mugambi has taken steps to ensure the safety and dignity of a woman involved in a legal case, who is referred to in court documents only by the initials M.R.W.
To protect her from any harassment or intimidation as the case unfolds, the judge has ordered that all related pleadings and documents be sealed, keeping her full identity confidential.
Additionally, court proceedings will be held in private when necessary.
In her petition, M.R.W. has accused a musician of sexual assault and is requesting the court to initiate investigations and preserve evidence linked to her claims.
Justice Mugambi has also instructed the police to securely gather and maintain all relevant documentary, digital, and electronic materials, including audio and messaging evidence from the woman.
The relevant custodians will receive further written preservation notices right away.
The court has also mandated that the petition and its accompanying application be served either in person or through a widely circulated newspaper within a week.
Responses must be filed within seven days of service, and rejoinders are permitted within a similar timeframe.
In this case, a woman has approached the High Court, seeking orders that would compel investigative and prosecutorial agencies to take action on her complaint against the well-known Kikuyu musician, Samuel Muchoki Ndirangu.
She asserts that she has preserved digital evidence of the assault, along with subsequent interactions with the artist, which include audio recordings and electronic messages where he allegedly insulted and threatened her.
In one of these exchanges, she claims he brushed off her attempt to confront him about the assault by labeling her a “professional prostitute.”
Additionally, she alleges that from 2021 to 2023, Samidoh engaged in manipulative and coercive communication with her, swinging between false friendliness and intimidation.
Through her legal representatives, Kaaya Memba & Company Advocates, the petitioner is urgently requesting orders for the police to register and investigate her case, preserve her evidence, and instruct the Attorney General to seek mutual legal assistance from U.S. authorities to obtain certified police and prosecutorial records.
She is also asking the court to direct the Witness Protection Agency to evaluate her risk and provide protection, citing concerns about harassment and intimidation.
M.R.W. argues that the state’s inaction has infringed upon her constitutional rights, including her rights to dignity, equality, personal freedom and security, fair administrative action, and access to justice.
