DJ Fatxo Finally Declared Innocent on Jeff Mwathi Death
Director of Public Prosecution Noordin Haji has provided a detailed account of the investigation into the tragic death of rising interior designer Jeff Mwathi.
In a letter dated May 9 and signed by Assistant Director of Public Prosecutions Gikui Gichuhi, the DPP explained to the DCI why the findings of the investigation do not warrant charging Lawrence Njuguna, also known as DJ Fatxo, with Jeff’s murder.
While reviewing the events from the day Jeff fell from the 10th floor of Redwood Apartment in Kasarani on February 22, the DPP noted that the investigation’s results, along with the CCTV footage, confirmed that DJ Fatxo and his companions (his cousin and driver) were not present in the apartment when Mwathi tragically fell.
“CCTV footage shows the deceased’s body hitting the ground and bouncing off the ground due to gravitational pull owing to the height of the fall and his phone getting out of his right hand immediately after he hit the ground.”
The DPP reports that after Dj Fatxo left the designer and his two friends in the house, CCTV footage captured him returning to the building at 9:05 am. During this visit, he was briefed by the security guards about what had transpired.
Just ten minutes before Jeff’s tragic fall, the DPP reported that DJ Fatxo’s cousin and driver were seen heading down the parking ramp at 5:37 AM, seemingly on the lookout for DJ Fatxo. They were also spotted making their way back up the same ramp at 5:39 AM and 5:40 AM.
Later, at 5:47 AM, they were caught on camera exiting the 10th-floor lift and returning to the house, right at the moment Jeff was seen falling.
“This indicates they were not in the house at the time of the deceased’s death,” the DPP stated.
Additionally, the DPP mentioned that DNA analysis from samples taken after a second autopsy, performed by Government Pathologist Johansen Oduor following the exhumation of Jeff’s remains at his parents’ home in Laika, Nakuru County, did not connect any of the three male friends to his death.
As a result, the DPP cleared the three of any involvement in the designer’s death.
“The totality of the witness statements and the documentary evidence in the file thus far do eliminate the suspicion that the death of the deceased was as a result of unlawful act or omission of the three persons of concern herein and/or that anyone of them had formed the intention of unlawfully killing the Geoffrey Mwathi,” the DPP concluded.
The letter recommended the formation of an inquest to unravel what could have happened.
“At this point in time, the information in the file does not meet the threshold for a charge as malice aforethought has not been established,’ Haji said.
