Moses Kuria Raises Concerns Over 2027 Elections Due to IEBC Delays
Moses Kuria recently clarified his comments about the upcoming General Election, suggesting that there might not be an election in 2027.
In a statement released on Monday, June 30, the adviser to President William Ruto pointed to the delays in fully establishing the Independent Electoral and Boundaries Commission (IEBC) as the reason for his predictions.
Kuria noted that the electoral body is still not fully constituted, even though we’re nearly two years away from the polls.
He mentioned that the ongoing legal disputes over the appointment of the IEBC commissioners could potentially reach the Supreme Court, which would create further delays for the Commission’s timelines.
Kuria also pointed out that if elections don’t happen, the Kenya Kwanza government will have to keep doing its job. “In just 39 days, we’ll kick off the 24-month countdown to the 2027 elections.
Kriegler reminded us that a free and fair election isn’t possible without a Commission in place two years ahead of time. Given our tendency to litigate, this case will likely make its way to the Supreme Court and could drag on until September 2027.”
“So the current administration will continue being in office in the absence of an election. I am not a Senior Counsel. I am not a lawyer. Kalonzo Musyoka is. He knows there is not going to be an election in 2027. The only difference is that I am honest and he is not,” Kuria stated.
The IEBC still hasn’t been fully formed due to a petition that was lodged in court concerning the recruitment of the commissioners. Although Justice Lawrence Mugambi has allowed Parliament to vet and approve the nominees, the court has put a hold on their swearing-in.
“The nominations fail to satisfy the requirements outlined in Articles 10, 27(1), 232, and 250(3) & (4) of the Constitution of Kenya, 2010, which emphasize the need for regional balance, ethnic inclusivity, and the representation of persons with disabilities.”
“Allowing the nominees to take office without addressing these concerns would render the petition moot, as constitutional provisions do not allow for removal of commissioners on grounds related to irregular appointments,” read part of the petition filed by activists Boniface Mwangi and Kelvin Roy Omondi.
Those who were nominated and approved to be IEBC commissioners include Erastus Edung (chairperson), Ann Njeri Nderitu, Moses Alutalala Mukhwana, Mary Karen Sorobit, Hassan Noor Hassan, Francis Odhiambo Aduol, and Fahima Araphat Abdallah.
